Participating in Credit Card Class Action Suits

  • Every once in awhile, you might get information in the mail which says that you are part of a class action law suit as a result of being a credit card holder with a certain company. This is rare but it happens. Whenever a class action lawsuit is filed against a credit card company or a lending institution, all of those people who can be affected by the results of the lawsuit are notified. In general, you don’t have to do anything in order to benefit from the lawsuit. However, you may want to stay abreast of the status of the credit card class action lawsuit in order to make sure that you get any awards that may be coming to you because of it.

    Class action credit card lawsuits

  • If you receive information in the mail stating that you are part of a class action credit card lawsuit, the first thing that you should do is to read through the information. Many people don’t understand the legal terms in these documents and so don’t bother to read through them. You should be able to understand enough to get the gist of what’s going on simply by reading through the literature carefully. Take the time to sit down in a quiet part of your home and read through the information that is being presented to you.

  • The main thing that you are going to want to look out for is whether you need to do anything in relation to having received this credit card lawsuit information. In almost all cases, you are being notified about the lawsuit because you automatically qualify as a participant in it. This doesn’t mean that you need to do anything about it. It simply means that you are someone who may potentially benefit from the lawsuit if it gets settled or if it goes to trial and is won in favor of the consumers.

  • However, in rare cases, you will need to file something stating that you have been affected by whatever has caused the lawsuit to come about. For example, let’s say that your rewards credit card company is being sued for overcharging customers on their late fees. You may be someone who has gotten such charges. In most cases, you won’t need to do anything. However, if the information sent to you specifically says that you need to file something stating that you’ve been overcharged for late fees, you’ll need to do that.

  • After the lawsuit has taken place, you will likely be notified again with the results of the lawsuit. In many cases, this will come with a check for the amount of damages that were awarded in the lawsuit. Don’t get too excited. In most cases, credit card lawsuits result in settlements that are dispersed across thousands and thousands of people. This means that even a lawsuit that garners millions of dollars will probably result in a check to you of just a few dollars and cents.
